New York surgeon prevails in first of more than 250 lawsuits

Doctors, nurses and surgeons are supposed to be on the lookout for infections whenever a patient complains of pain. A doctor's failure to diagnose an infection can have catastrophic consequences, and injured patients or their families need to be aware of their rights under current medical malpractice law.A medical negligence case involving a knee infection was recently decided in Westchester County. The wife of a man who died in 2008 sued the surgeon who took a fluid sample from the man's knee. However, the surgeon chose not to send the sample off to be tested for infection. The 78-year-old patient died the month following his visit with the surgeon. An expert witness testified that the surgeon failed to provide the standard of care when he didn't have the fluid sample tested. Can a recording device help protect against fatal truck crashes?

Many of us in Rockland County have turned on the news to hear about a semitrailer truck causing a fatal accident. Unfortunately, trucking accidents are incredibly common in New York, and often they are caused by overworked, fatigued and dangerously drowsy drivers. Although some may say that it is just part of the job, no job should put profit ahead of their employees' and bystanders' safety and lives. Trying to rationalize pushing truckers to their limits comes up short when their drivers cause fatal accidents.Although family members can file a wrongful death lawsuit following the loss of a loved one in a trucking accident, they would probably rather have that loved one alive and well. Pushing for safer trucks, safer working conditions for truckers and a way to better enforce [...]

Attorney General advocates for reduced drug sentences

U.S. Attorney General Eric Holder was scheduled to testify before the U.S. Sentencing Commission that the federal mandatory minimum prison sentence for certain drug-related offenses should be reduced. In particular, he is endorsing a move to reduce the sentence for federally convicted drug dealers in New York and nationwide by one year, from 62 months to 51 months. His prepared remarks, which were released to the press ahead of his scheduled appearance before the commission, argue that the justice system's overreliance on incarceration for drug offenses is unsustainable and should be curtailed. His statement also argues that the high rates of incarceration have high moral costs that cannot be calculated. The Attorney General has instructed federal prosecutors not to object to certain requests for sentence reductions in drug cases where the [...]

The future of bicycle safety may be quite high tech

There are a number of bicycles in Rockland County and there is a good reason for the bicycle craze. Not only is it a lot less expensive to get from point A to point B by bike, but it also provides a degree of exercise that many people in New City may be too busy to get done. While there are a number of positives about riding a bicycle, there are also a number of risks. Not all of the drivers out there are paying attention to cyclists and it only takes a moment of distraction to cause a serious or fatal accident.Fortunately, four mechanical engineering students have been working to create a bicycle that will help protect its rider, even from poor or distracted drivers. This high-tech bike is [...]
